West Virginia became the 8th state to enact theKratom Consumer Protection Act with the signature of Governor Jim Justice onMarch 23, 2023. This victory is particularly significant since the FDA disinformation campaign against kratom had initially led leading legislators to support a kratom ban bill.
Kratom advocates, backed by science, overcame the FDA disinformation campaign and achieved a significant victory for consumers and good public policy. The law, which becomes effective in 90 days, will undergo rule making by the Department of Agriculture whose leaders have pledged to work with the American Kratom Association (AKA) to ensure protections for access to safe kratom products for consumers.
